Terms and conditions
This is a translation for your convenience. The German version is legally binding.
§ 1 Scope and provider
These terms apply to all purchases on “Try and sew me” (at seamstofitperfectly.com). The provider and your contractual partner is [First and last name], [address], email [Email address] (see imprint).
§ 2 Service
We create digital sewing patterns calculated from the measurements and options you enter. The pattern set consists of the dog coat, the raincoat, the sweater, the hoodie, the vest and the onesie, each of which you can deselect; the bandana, snood and belly band are always included. You receive them as PDF (A4, US Letter, A3, A0) and SVG to download. The download link is valid for 90 days from purchase; please save the files within this time.
The pattern follows your input, so the fit depends on measuring as described. Every dog is built differently; we recommend trying the pattern with test fabric first.
§ 3 Conclusion of contract
What the website shows is not yet a binding offer. By confirming the payment with the Apple Pay button you make a binding offer. The contract is concluded when the payment is confirmed and we provide the pattern for download. The contract language is English or German, as chosen on the website.
§ 4 Price and payment
The price depends on your selection and is shown on the website (currently €1 for each selected pattern out of coat, raincoat, sweater, hoodie, vest and onesie, so €6 for all six). Without these six the set is free; no purchase contract is concluded for it, but the rights of use in § 6 apply. You may choose to pay a higher amount. All prices are final prices. No VAT is charged in accordance with § 19 UStG (German small business regulation). Payment is made with Apple Pay and processed by Stripe.
§ 5 Delivery
The pattern is available for download on the website right after the payment is confirmed. You also receive a payment receipt with the download link by email.
§ 6 Rights of use
You receive a simple, non-transferable right to use the files, to print them and to sew items from them – for your own dog, as a gift or for sale. You may also sell items sewn from them commercially. The files and printouts themselves must not be shared, published or sold.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal, see withdrawal policy. It ends when we start providing the pattern after you have expressly agreed to this and confirmed that you lose your right of withdrawal as a result.
§ 8 Warranty and liability
The statutory rights for defects of digital products apply. We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slight negligence we are only liable for the breach of essential contractual obligations, limited to the foreseeable damage typical for the contract.
§ 9 Final provisions
German law applies. If you are a consumer habitually resident in another EU country, the mandatory consumer protection rules of that country remain unaffected.
